The $1300 was the amount they said was still outstanding (at least, that's one of the figures they've given... it changes from one correspondence to the next) Our contention - and bank statements that back us up - is that we've paid over the $13,000 for the year that they say should have been paid for the year.<br /><br />Our payments were supposed to be for 5 mos $989/mos (Dec 2010-April 2011)<br />and then for 8 mos at $1027/mos (May 2011-Dec 2011)<br /><br />In total, OUR bank statements show we've paid over $13,161, because we've been overpaying on most months... the $13k was just what we owed based on payment amounts, but we've paid more than that. Their lawyer says we've only paid $11k. But we can prove otherwise, for all the good it does. <br /><br />And also note - our mortgage payments mysteriously went up in May (and weren't notified of this until half-way through May) despite the fact that our taxes did not go up, (property values have tanked in Omaha so tax value hasn't increased) and we got new homeowners insurance in November that should have REDUCED our payment amounts by over $60/mos. In this post I detail that the claims from their attorney show an acknowledgement of received funds that is approx. $1300 from what was actually owed. The attorney has not included payments confirmed by PHH on their statements, or by their EVP Marty Foster, nor does it include all the payments my bank has confirmed. We offered to pay the difference - just under $1300 and meet to discuss the outstanding amounts and this was refused. <br /><br />Despite holding over $9,000 of our money that they have not applied, they are insisting an additional $9,000 is due, plus late fees, attorney fees, etc. <br /><br />Not sure, where there the $13,000 came in without re-reading. To date I have paid, according to their annual statements over $215,000. Through March 2012 I would need to make 155 monthly payments, that have been under $1000/month up until May of 2011. So - $155,000 (and that is high).
